I _think_ the lib pragma indicates the first place to look for a module,
therefore presumably simply installing the patched modules in the
MailScanner lib directory should be sufficient (meaning no real changes
to MS and only a compile time change and the patches to MIME tools.

Unfortunately I suspect there may be license issues which could preclude
packaging them together (artistic vs GPL), although perhaps a possible
solution would be a seperate dependant package?

I suspect the Gentoo devs may be unwilling to accept non official
patches to a standard package (particularly a not-latest version),
particularly as this is depended upon by other packages (such as
Amavis).  Has anyone approached the maintainer(s) of the Gentoo
package?  [The gentoo package changelogs for both Mime-Tools and Amavis
list some of the same people, this may or may not be an obstacle].

The other problem I see is with the risk that this is essentially
forking MIME tools, which it would really be nice to avoid

I've just starting to get to grips with Gentoo myself, so I also have an
interst in getting a proper ebuild sorted out (and would be happy to
help, although right now I have zero experience with making ebuilds).
