Linux file command identifies text-file as DOS executable (COM)

A funny thing came a cross my eyes...

if your using file v5.14 to detect executeables and you put this "锘"
chinese charakter at the beginning of a text-file it will be detected as 
DOS-Executeable (COM). I'm wondering if i schould upgrade to file 5.24.

Are there known issues with file v5.24 and Mailscanner?

# file msg-17333-4.txt
msg-17333-4.txt: DOS executable (COM)

# file --version
file-5.14
