Yes I have the link for mailscanner.cf pointing to /etc/MailScanner/spam.assassin.pref.conf all owned by root. And have added a custom.cf with the score setting and still getting scored 3.38

Your cf files should go into /etc/mail/spamassassin; you should have the 
following link in there:
/etc/mail/spamassassin/mailscanner.cf -> 
/etc/MailScanner/spam.assassin.prefs.conf
